GENERAL TERMS AND CONDITIONS

1. Scope of application

Concerning the business connection between admago GmbH (see above) – acting unter the trademark Inside-Gallery – and the costumer / buyer the following general terms and conditions exclusively apply in its ordering at the time of your order. Deviating times of the customer are not accepted by Inside-Gallery, unless Inside-Gallery has explicitly and in written form agreed on its validity.

2. Formation of a contract

The depiction of the products in the online shop portray a legally binding offer, but a non-binding online catalogue. The products put into the ’’Shopping cart’’ by the costumer/buyer are concededly shown in the order overview. Here, the customer / buyer can check all of his provided details throughout the ordering process.
By clicking the Button ‚’’Buy Now’’, the costumer / buyer sends his ordering data and declares towards Inside-Gallery to bindingly order the respective products. The bid of the costumer/buyer is accepted by Inside-Gallery. Immediately after sending the order, the customer / buyer receives an confirmation of contract listing the details of the order of the customer / buyer.

3. Cancellation policy

We advert to the fact, that the offered photo works are not prefactured and that for its manufacturing the individual choice and therefor the decision of the buyer is essential. That is why, according to § 312 g par. 2 Nr. 1 German Civil Code there is no right of cancellation of the order. See our whole cancellation policy.

Yet, customers / buyers of an artwork can cancel their order for free prior to transfer of the purchase amount. In that case, please use the contact form. On the day of ­transfer, the manufacturing of the individually configurated artwork begins. At this point the order can no longer be cancelled.

4. Delivery, shipping and acceptance

The order comprises:

  • the exclusive and individual1 fine art-work
  • the certificate signed by the photographer (works in limited)
  • a hanging system in gallery quality and
  • delivery charges within Germany2

1 Possible by choice of picture size, choice of refinement with Liquid-Gloss or museum acrylic and framing / passe-partout-selection.

If not previously agreed, the delivery ensues from the manufacturing place to the address of the costumer / buyer or the respectively stated delivery address. The period of delivery within Germany is about 2-3 weeks, within the EU is till 4 weeks, thanks to piece production – after receipt of money on the account of admago GmbH.

Concerning any delivery- or transport damages, the buyer has to check the product for any damages and inform the shipping agent before the acceptance. In case of any defects noticed after the acceptance, the buyer has to inform Inside-Gallery within the time limit of five days. This can be done using the contact form. If the buyer neglects to do so, the enforcement of notice of defects for such obvious damages is impossible.

5. Certificates and ’’artist’s proofs’’-certificates

For organisational reasons Inside-Gallery can send the respective certificate separately. The subsequent filing of the certificates do not constitute a deficiency.

6. Prices, maturity and payment

The prices stated in the shop are final prices including value added tax. The customer pays the price immediately after their order per transaction or PayPal (Payment options). No further costs emerge through Inside-Gallery or Paypal.

7. Delivery charges

Within Germany, Inside-Gallery does not charge shipping costs. Additional costs for delivery to islands and special delivery dates are not included.

When delivering to foreign countries, the customer / buyer chooses their desired country and the costs are shown respectively. Delivery is – except in Austria and Switzerland – free curb, without unloading. In Austria and Switzerland, the supply to the house or apartment door occurs.

8. Offsetting and retention

The right of retention is only due to the customer / buyer if their counter-claims are legally assessed or accepted by Inside-Gallery. They are further only authorized to exercise their right of retention if their counter-claim is based on the same contract law.

9. Responsibility

Inside-Gallery is only liable if Inside-Gallery or one of its proxies has grossly violated its contractual commitment or if any damage is based on wanton negligence of Inside-Gallery or one of its proxies.
Where there has been no reckless or negligent conduct, the liability of Inside-Galleries is limited to the damage, that was reasonably foreseeable at the time of conclusion of the contract. The liability concerning guaranteed quality structure, personal damage and based on mandatory legal provisions – stays untouched.

10. Warranty, proper handling

Inside-Gallery guarantees highest quality claims. With proper handling of the work, a resistance to light of 75 years is guaranteed.
The legal warranty period of two years begins with the full delivery of the products (photo work and certificate). Throughout that time all defects, that are subject to the seller’s warranties, are fixed for free. Exempted from the warranty are damages, that can be traced back to natural attrition, inappropriate use or lacking or inadequate care. Apart from that, we point to  § 4 – immediate contest of damage in transport or delivery.

Important Information on warranty

Due to the custom-made by hand of passe-partout can cause tolerance both in dimensions and in the shape and flatness to +/- 1 mm. This is not a defect. When finishing with Liquid GLOSS ™ may very small bumps or irregularities arise, which are also no shortage. The photo works are produced using the highest-quality paper and printing ink as well as using high-quality refinement and framing. The manufacturers of these materials guarantee a light fastness of at least 75 years, 100 years concerning black and white-prints. Yet, photographs can change due to environmental impacts. That is why photographs, refinements and frames should neither be- partly or entirely exposed to direct or strong insolation- hanged directly above heatings- exposed to air moisture exceeding the normal level of housing spacesPhotographs, refinements and frames are therefore not recommended for outdoor space, basement rooms, bathrooms or kitchens. Liquid Gloss, surface and wooden frames should only touched with the gloves or comparable protection.

11. Right to the photo work, exhibitions

With the buy of the photographic copy the costumer / buyer only obtains the ownership of the print. No further usage rights are conceded. Every reproduction, dissemination, renting, analog or digital accessibility to the public is not authorized. Yet, the customer / buyer can resell the print. Public display of acquired artworks requires the agreement of the photographer.

12. Usage of personal data

Data and Information, e.g. of customer satisfaction surveys, that Inside-Gallery receives from the customer / buyer helps to improve the shopping experience.
Inside-Gallery uses sent data and information for the processing of orders, the distribution and the transaction of the payment. Inside-Gallery also uses data and information of the customer / buyer to communicate with them concerning orders, products, offers as well as maintaining and taking care of the customers accounts, as well as building contents such as the wish list or shopping cart contents and to – if agreed – recommend products or services the customer might be interested in.

Inside-Gallery uses data and information of the customer / buyer also for improving their offers, preventing or discovering misuse of its website and enabling a third party to perform technical, logistical or other services commissioned by Inside-Gallery (Privacy protection).

13. Online dispute resolution

We are not committed and ready for online dispute resolution. This platform will be established by the European Union: http://ec.europa.eu/consumers/odr/index_en.htm

14. Right and place of jurisdiction

German right to the exclusion of the UN Convention on Contracts for the International Sale of Goods applies. Place of jurisdiction for all  jurisdiction is Erfurt, Germany.
